Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and MJW Media, the owner and operator of Zestly® ("MJW Media", "Zestly", "we", "us", or "our"), governing your use of the Zestly mobile app, website at zestlyapp.com, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility & Accounts
- You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service.
- You are responsible for your account, for keeping your credentials secure, and for all activity under your account. Provide accurate information and keep it up to date.
- Some features (e.g., entering challenges, voting, redeeming rewards) may require a verified email and phone number and may have additional eligibility requirements.
2. The Service & AI Content
Zestly helps you discover, generate, create, save, and share recipes; log your cooking; participate in cooking challenges; and earn points and rewards. Recipes and other content may be generated using artificial intelligence and may contain inaccuracies or errors. You are solely responsible for evaluating recipes before relying on them, including for food safety, allergens, dietary restrictions, and nutritional needs. Any dietary labels or badges shown with a recipe (for example, vegan, vegetarian, pescatarian, gluten‑free, or dairy‑free) and any calorie or nutrition figures are automatically estimated from the listed ingredients, may be incomplete or incorrect, and are not a guarantee or certification. Do not rely on them if you have a food allergy, intolerance, or medical dietary requirement — always verify every ingredient yourself. We do not warrant that any recipe or AI‑generated content is accurate, complete, safe, or suitable for you.
3. Subscriptions, Billing & Refunds
- Zestly offers paid subscription tiers (currently Chef and Master Chef). Features and limits for each tier are described in the app and may change over time.
- iOS: subscriptions are sold through Apple In‑App Purchase and billed to your Apple ID. Payment is charged at confirmation of purchase. Subscriptions renew automatically for the same period and price unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your Apple ID settings. Your Apple ID account is charged for renewals within 24 hours prior to the end of the period.
- Web: subscriptions are billed through Stripe and renew automatically until cancelled.
- Refunds: except where required by law, all payments are final and non‑refundable, including for partial subscription periods. Purchases made through Apple are subject to Apple's refund policies; web purchases are subject to ours.
- Cancellation: cancelling a subscription stops future billing; it does not entitle you to a refund of amounts already paid or to a prorated refund for the remainder of the current period. You keep paid features until the end of the period you paid for, after which your account reverts to the free tier.
- Unused benefits: unused recipe generations, points, entries, or other benefits have no cash value and are not refunded, credited, or carried over on cancellation, downgrade, expiration, or termination.
- Changes: we may change prices, plans, features, and limits prospectively; we will provide notice where required.
4. Points, Challenges & Rewards
- Points and rewards are a promotional feature, have no cash value, are not your property, and cannot be purchased, transferred, sold, or exchanged for cash. Points are not refundable under any circumstances, including on account cancellation, subscription changes, challenge cancellation, or termination.
- Points may be earned only through legitimate activity. We may adjust, withhold, freeze, expire, or revoke points or rewards in cases of error, fraud, abuse, or violation of these Terms, and we may modify the points system — including earning rates, redemption values, caps, and available rewards — or discontinue it entirely, at any time without liability.
- Challenges: entry fees (paid in points) are non‑refundable. We may modify, suspend, or cancel any challenge at any time, for any reason, without notice and without liability; if a challenge is cancelled before winners are selected, we may — at our sole discretion and without obligation — return entry‑fee points to entrants. Entries must use the stated theme ingredient, include required media, and be your original work. You may enter once per challenge unless stated otherwise, and limits on concurrent and monthly challenges may apply.
- Eligibility & integrity: challenge entry and voting may require account age, a verified email and phone, prior cooking activity, and a shipping address (for physical rewards). Manipulating votes, points, or challenges — including using multiple accounts, coordinated or same‑device/IP voting, or automated activity — is prohibited and may result in disqualification, forfeiture, and account action.
- Winners & rewards: community voting may determine finalists; administrators confirm winners, and their decisions are final. Ties may result in split points. Reward amounts depend on the challenge tier and placement as displayed in the app. We may modify, suspend, or cancel any challenge or reward.
5. User Content & License
You retain ownership of content you create and submit ("User Content"). By submitting User Content, you grant Zestly a worldwide, non‑exclusive, royalty‑free, sublicensable license to host, store, reproduce, adapt, publish, display, and distribute it in connection with operating, promoting, and improving the Service. You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate any law or third‑party right. You can remove your User Content or delete your account, though copies may remain in backups or where shared publicly.
6. Acceptable Use
You agree not to: violate any law or regulation; infringe others' intellectual‑property or privacy rights; upload harmful, fraudulent, offensive, hateful, or illegal content; impersonate others or misrepresent yourself; manipulate points, votes, challenges, or reviews; upload content that isn't your own original work where originality is required; reverse engineer, scrape, or overload the Service; bypass security or rate limits; or use the Service to harass others or distribute malware. We may remove content and suspend or terminate accounts that violate these Terms.
7. Moderation
User‑submitted media and content may be reviewed by automated systems and/or staff. We may reject, remove, flag, or limit content, and disqualify entries, at our discretion to protect users and the integrity of the Service.
8. Intellectual Property
The Service, including the Zestly® name and logo, software, and design, is owned by MJW Media and protected by intellectual‑property laws. Zestly® is a registered trademark owned by MJW Media (USPTO Reg. No. 8272035). All related marks, logos, product names, and brand features are trademarks or trade dress of MJW Media. Except for your User Content and the limited license we grant you to use the Service, no rights are transferred to you, and you may not copy, use, or register the Zestly® marks or any confusingly similar marks without our prior written permission.
9. Suspension & Termination
You may stop using the Service and delete your account at any time (Settings → Danger Zone). We may suspend, restrict, or terminate your account or access to any part of the Service at any time, for any reason or no reason, with or without notice, and without liability to you. Reasons may include, but are not limited to, violation of these Terms, suspected fraud or abuse, legal or security concerns, extended inactivity, or discontinuation of the Service or any feature.
Upon suspension or termination: (a) your license to use the Service ends; (b) all points, rewards, entries, and other promotional benefits are forfeited without compensation; and (c) except where required by applicable law, fees already paid are not refunded (purchases made through Apple remain subject to Apple's refund policies). Sections that by their nature should survive termination — including Sections 5, 8, and 10–13 — will survive.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the Service will be uninterrupted, secure, or error‑free, or that any content (including AI‑generated recipes) is accurate or safe.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZESTLY AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $100.
12. Indemnification
You agree to indemnify and hold harmless Zestly and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law or third‑party right.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict‑of‑laws rules. The exclusive venue for disputes will be the state or federal courts located in New York, unless otherwise required by applicable law. 14. Changes to These Terms
We may modify these Terms from time to time. Material changes will be posted here with an updated date and, where appropriate, additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
